Transgender rights in the workplace
Transgender rights in the workplace, rights for people who have a gender identity or gender expression which is different from the sex that they were assigned at birth, are protected by United States law. Transgender discrimination in the workplace is a persistent problem. Firing employees because of their sexual orientation or transgender status violates United States law in regard to the prohibition on discrimination because of sex. Focusing on the plain text of Title VII of the Civil Rights Act of 1964, the Court reached its holding. The Court provided the explanation: “discrimination based on homosexuality or transgender status necessarily entails discrimination based on sex; the first cannot happen without the second.” Transgender rights in the workplace are enforced by the Equal Employment Opportunity Commission (EEOC). Transgender in the workplace are entitled to the same rights as other employees, and are entitled to a workplace without LGBTQ workplace discrimination. Transgender employment rights make it illegal to refuse to hire, or to fire a person because of their transgender status.
