Hostile Work Environment
Even though the difference between quid pro quo harassment and hostile environment harassment are in a sense different claims, the difference between them is not always apparent, and both types of harassment in many cases occur simultaneously. When submission to unwelcome sexual conduct is made either explicitly or implicitly a term or condition of an employee’s employment, this could constitute a hostile work environment. In regard to employer liability for hostile work environment harassment, there is a standard. According to the Supreme Court, hostile work environment harassment typically depends on whether or not the harasser is the supervisor of the victim. If an employer has empowered a particular employee to take tangible employment actions against another employee, in this case the victim of sexual harassment, for example, to cause important modifications to the victim’s employment status, such as hiring, firing, failing to promote, reassignment with significantly different responsibilities, or a decision causing a significant change in benefits, than the employee making those decisions would be considered a supervisor, according to the court. Employers are vicariously liable for a hostile work environment created by a supervisor.
