According to the Supreme Court, hostile work environment harassment typically depends on whether or not the harasser is the supervisor of the victim. If an employer has empowered a particular employee to take tangible employment actions against another employee, in this case the victim of sexual harassment, for example, to cause important modifications to the victim’s employment status, such as hiring, firing, failing to promote, reassignment with significantly different responsibilities, or a decision causing a significant change in benefits, than the employee making those decisions would be considered a supervisor, according to the court. Employers are vicariously liable for a hostile work environment created by a supervisor.
